Mediation.  Mediation is a voluntary, confidential form of dispute resolution in which the parties work with a neutral third party, the Mediator, to reach an agreement or an accord which resolves their differences .

In most matters, we advocate mediation at the early stages of a dispute. In business and in personal matters, mediation can be invaluable in assisting the parties to work together to reach common goals, and in reaching agreements which can keep relationships intact, and keep business running when they might otherwise have dissolved.  In those matters, mediation prior to litigation or in the early stages of litigation can be beneficial. 

We recognize that in other matters (for example, personal injury cases and other cases in which obtaining discovery through the court system is critical), mediation needs to occur later in the litigation process.  In those matters, we are certainly available to mediate up to the eve of trial.

Arbitration.  In Arbitration, the parties submit their dispute to a neutral third party, who makes final written decisions which resolve the dispute and which are binding upon the parties.  Arbitration is very much like an informal version of court, with the Arbitrator functioning like a judge. 

We arbitrate all disputes (either as the sole arbitrator, or as the neutral on an arbitration panel) including:

Facilitation.

We facilitate public processes, workplace issues, conferences, and strategic planning retreats. 

We have done this for private and public groups, including governmental agencies, municipalities, and schools.
